Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Silas Fitness mobile application ("App"), operated by Carl Caum ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Service Description

Silas Fitness is an AI-powered fitness and nutrition coaching application. The App provides workout planning, nutrition tracking, exercise guidance, and recovery recommendations generated by artificial intelligence.

2. AI-Generated Content Disclaimer

The App uses artificial intelligence to generate fitness and nutrition recommendations. You acknowledge and agree that:

• AI-generated recommendations may contain errors, inaccuracies, or suggestions that are not appropriate for your individual circumstances
• The App is not a substitute for professional medical advice, diagnosis, or treatment
• AI technology has inherent limitations and may not account for all relevant health factors
• Recommendations are based on the information you provide and may not reflect your complete health picture
• You should consult with a qualified healthcare professional before starting any new exercise program, making significant dietary changes, or if you have any medical conditions

3. Assumption of Risk

You expressly acknowledge and agree that:

• Physical exercise carries inherent risks including but not limited to muscle strains, sprains, fractures, cardiovascular events, and in extreme cases, serious injury or death
• You voluntarily assume all risks associated with using the App and following any exercise programs, workout routines, nutritional guidance, or recovery recommendations provided
• You are solely responsible for determining whether any exercise, workout, dietary recommendation, or activity suggested by the App is appropriate and safe for you
• You will stop any exercise immediately if you experience pain, dizziness, shortness of breath, or any other concerning symptoms
• The App's calorie estimates, macro calculations, and nutritional information are approximations and should not be relied upon for medical dietary needs

4. Not Medical Advice

The App does not provide medical advice. All content, recommendations, workout plans, nutrition guidance, and recovery suggestions are for informational and educational purposes only. Nothing in the App should be construed as medical advice or a substitute for consultation with a qualified healthcare provider.

If you have any medical conditions, injuries, or health concerns, consult your doctor before using this App.

5. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you are at least 18 years of age and have the legal capacity to agree to these Terms.

6. Account and Data

• You are responsible for the accuracy of information you provide to the App
• Your workout data, nutrition logs, and chat history are stored on your device and optionally in iCloud
• You are responsible for maintaining the security of your device and iCloud account

7. Subscriptions and Billing

• Some features of the App may require a paid subscription
• Subscriptions are billed through Apple's App Store. Apple handles all payment processing, renewals, and refunds
• Subscription automatically renews unless canceled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds are provided for unused portions of a subscription period

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any injuries, health complications, adverse effects, or damages of any kind resulting from your use of the App or reliance on its recommendations
• We are not liable for any errors, inaccuracies, or omissions in AI-generated content
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is greater
• We make no warranty that the App will be uninterrupted, error-free, or free of harmful components

9. User Content

By providing content to the App (including photos, workout data, nutrition logs, and chat messages):

• You retain ownership of your content
• You grant us a limited license to process your content solely for providing the App's services (e.g., sending photos to AI for meal analysis)
• You agree not to upload content that is illegal, harmful, or infringes on third-party rights

10. Data Processing

• The App sends certain data (including text messages and photos) to third-party AI services (Anthropic) for processing
• This processing is necessary to provide AI coaching features
• We do not sell your personal data to third parties

11. Intellectual Property

The App and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.
